Q.What is the mutual consent divorce timeline?
Under Section 13B of the Hindu Marriage Act, 1956, the statutory framework contemplates two motions before the Family Court with an interregnum of six months (waivable in appropriate cases as per Supreme Court guidance), followed by the decree upon the court's satisfaction.
Q.What constitutes a legally enforceable debt under Section 138?
The cheque must be issued for discharge, in whole or in part, of a legally enforceable debt or other liability. The statutory sequence — presentation, return unpaid, written notice within thirty days, and complaint within the limitation period — must each be strictly complied with.
Q.How are child custody matters evaluated?
Courts assess the welfare of the child as the paramount consideration — encompassing stability, education, emotional attachment and the capacity of each parent — rather than any presumption in favour of either parent.
Q.What is HUF property, and how is it partitioned?
Property belonging to a Hindu Undivided Family is held collectively. Partition may occur by mutual arrangement, through a partition deed, or by a suit for partition — with shares determined per the personal law governing the family.
Q.Why is probate necessary?
Probate is the court's certification of a will's validity. In Gujarat, it establishes the executor's authority to administer the estate and is often required for immovable-property mutation and transfer.
