Probate of Wills

Probate establishes the legal validity of a Will and grants the executor the authority to administer the deceased's estate. It is often a mandatory prerequisite for the mutation of immovable property and the release of high-value banking assets.

The Legal Process:

  • Filing the probate petition before the competent court of jurisdiction.
  • Issuing public citations and managing potential objections or caveats from legal heirs.
  • Securing the final grant of probate to execute the testator's wishes seamlessly.

Succession Certificates

In cases where an individual passes away intestate (without leaving a valid Will), a Succession Certificate is required to establish the rightful legal heirs.

Letters of Administration

When a person dies intestate leaving behind an estate that requires administration, or if a Will exists but no executor is named (or the named executor declines), the court grants Letters of Administration.

Q.What is the difference between Probate and a Succession Certificate?
Probate applies when a deceased person has left a valid Will. A Succession Certificate is typically obtained when a person dies intestate (without a Will) and is used primarily to establish the legal heirs' rights to realize the debts and securities (movable assets) of the deceased.
